We comply with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, which provides safe harbor protections for online service providers from liability for copyright infringement by third parties.

How to Submit a DMCA Takedown Notice To be effective under the DMCA, your notice must be a written communication that includes substantially the following (per 17 U.S.C. § 512(c)(3)):

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material (e.g., URL or direct link).
  4. Information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
  5. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Counter-Notification If your material was removed or access disabled in response to a takedown notice, and you believe it was removed in error or misidentification, you may file a counter-notification under 17 U.S.C. § 512(g)(3). The counter-notice must include:

  • Your physical or electronic signature.
  • Identification of the material removed or disabled and the location where it appeared before removal.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Your name, address, telephone number, and a statement that you consent to the jurisdiction of Federal District Court for the judicial district in which your address is located (or if outside the US, for any judicial district in which the service provider may be found), and that you will accept service of process from the person who provided the original takedown notice or their agent.

We will forward your counter-notice to the complainant. If we do not receive notice within 10–14 business days that the complainant is seeking a court order, we may restore the material at our discretion.

Repeat Infringers We reserve the right to terminate accounts or access of repeat infringers in appropriate circumstances.

Registration Recommendation To fully qualify for DMCA safe harbor protections, we recommend registering your designated agent with the U.S. Copyright Office’s Designated Agent Directory at https://dmca.copyright.gov/osp/. This is separate from posting this policy and requires a fee.
